A bid so low the contracting authority must investigate before awarding — sustainability, labour law, or state-aid concerns.

Under Regulation 69 of S.I. 284/2016 (transposing Article 69 of Directive 2014/24/EU), a contracting authority must request an explanation in writing where a tender appears abnormally low in relation to the works, supplies, or services. The authority can only reject the tender if the explanation does not satisfactorily account for the low price — for example, where the bidder cannot demonstrate compliance with environmental, social, and labour law obligations. Common in construction and FM tenders where a price gap of 20–30% below the next bidder triggers scrutiny.
